§48E Energy Storage Tax Credits: What a Buyer Should Know

· By the Veritas Tax Credits editorial team (how we write and check) · Educational only, not tax advice

Energy storage is the part of §48E least affected by the 2025 law's wind and solar cutoffs, and third-party data shows storage taking a bigger share of credit transfers in 2026. It also has its own diligence points: battery supply chains and the foreign-entity rules. This page covers both.

What qualifies

§48E covers "energy storage technology" placed in service after 2024, including battery storage and certain other storage of at least 5 kWh capacity, whether standalone or paired with generation (§48E(c); IRS). The credit is a percentage of the basis of the storage placed in service in the year.

Rates

  • Base 6%; 30% if prevailing wage and apprenticeship rules are met or the project is under 1 MW (output) (§48E(a)(2)).
  • Bonus credits: energy community and domestic content (10 percentage points each at the full rate).
  • No fixed end date: the credit phases down only after the later of 2032 or when US electricity emissions fall to 25% of 2022 levels (IRS).

Why storage matters in 2026 (third-party data)

  • Crux reports standalone battery storage grew to 7% of H1 2026 transfer volume from 5%, and solar-plus-storage to 12% from 5%.
  • Crux's survey found 32% of market participants cited a move toward storage to access §48E, and it expects storage to become the main driver of new capacity as safe-harbored solar is built out.
  • Storage placed in service at a wind or solar facility is excepted from the wind and solar termination (§48E(e)(4)(C)).

The foreign-entity test is the hard part

Storage that begins construction after December 31, 2025 cannot include material assistance from a prohibited foreign entity (§48E(c)). The test is the material assistance cost ratio: for storage beginning construction in 2026 the threshold is 55%, rising 5 points a year to 75% for 2030 and later (Notice 2026-15, as summarized by McGuireWoods). Notice 2026-15 includes safe harbors, supplier certifications, and an allocation method for distributed storage under 1 MW AC, but leaves open questions about ownership and effective control. Crux says tax credit insurance still does not cover most foreign-entity risk.

Buyer diligence for storage

  • MACR calculation and supplier certifications for cells, modules, inverters and other listed components.
  • Construction start date, and which rules apply to it.
  • Placed-in-service evidence: interconnection and commissioning.
  • Prevailing wage and apprenticeship records for the 30% rate.
  • Property and casualty insurance. Fire and weather events are the recapture risk for batteries.
  • Lender forbearance, anti-transfer covenants and indemnity (checklist).

Storage is not risk-free. It has the same five-year recapture as other ITC property, plus supply-chain compliance. See the §48E buyer guide and the credit comparison.

Frequently asked questions

Is energy storage covered by the wind and solar termination?

No. §48E(e)(4)(C) excepts energy storage placed in service at a wind or solar facility, and storage generally is outside the termination. Storage still has its own phase-down and foreign-entity rules.

What is the foreign-entity threshold for storage?

For construction beginning in 2026, the material assistance cost ratio threshold for energy storage is 55%, rising to 75% for construction beginning in 2030 or later, per Notice 2026-15 as summarized by McGuireWoods.

Is a storage credit lower-risk than a solar credit?

Not necessarily. Storage avoids the wind and solar termination dates but still carries five-year recapture and supply-chain (foreign-entity) diligence. Risk depends on the specific project and seller.

How much storage is being sold as credits?

Crux reports standalone storage at 7% and solar-plus-storage at 12% of H1 2026 transfer volume. Those are third-party figures and may change.
